1. Definitions

• "Service" refers to Captain Memo, our goal-oriented memo processing and learning assistance application
• "Company" refers to Leo Crafter s.r.o., a company registered in Czech Republic
• "User" refers to any individual or entity using our Service
• "Content" includes voice recordings and any data you provide to our Service (note: memo content is never stored permanently)

2. Account Eligibility

To use Captain Memo, you must be at least 16 years old and have the legal capacity to enter into these terms. By creating an account, you represent that all information provided is accurate and current.

3. Service Description & Subscriptions

Captain Memo provides goal-oriented memo processing with privacy-first architecture. Important: We process your thoughts without storing memo content permanently. Voice recordings are temporarily cached (max 90 days) for processing purposes only.

Our service operates on a subscription basis with different tiers offering varying features and usage limits. Subscription fees are billed according to your chosen plan. You may cancel your subscription at any time, with cancellation taking effect at the end of your current billing period.

4. Intellectual Property Rights & Data Ownership

Your data stays yours. You retain full ownership of all content you provide to our Service. Since we don't store memo content permanently, your intellectual property remains entirely under your control.

By using Captain Memo, you grant us a limited, temporary license to process your content in real-time solely for providing our Service. This processing license expires when processing is complete (typically seconds).

The Captain Memo software, trademarks, and associated intellectual property remain our exclusive property.

5. Acceptable Use Policy

You agree not to:

• Use the Service for illegal activities or to violate any applicable laws
• Share accounts or provide access to unauthorized users
• Attempt to reverse engineer, hack, or compromise our Service
• Upload content that infringes on others' rights or contains harmful material
• Abuse our Service in ways that could impact other users or our infrastructure

6. Data Processing & Privacy

Our processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms. We implement appropriate security measures to protect your information.

7. Service Availability & Warranties

While we strive for high availability, we cannot guarantee uninterrupted service. Captain Memo is provided "as-is" without warranties of any kind, whether express or implied.

We disclaim all warranties regarding merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, Leo Crafter s.r.o. shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, profits, or business interruption.

Our total liability for any claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Governing Law & Dispute Resolution

These terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the competent courts of Prague, Czech Republic.
